12.1. Custom Components Warranty & Liability

  • For any builds of servers, workstations or other devices where customers have requested the use of custom or specific hardware components not part of the standard DiGiCOR offering, DiGiCOR makes no representation or warranty, express or implied, as to the fitness of such custom components, including, but not limited to, their compatibility with DiGiCOR’s products. It is the customer’s responsibility to ensure compatibility and fitness for purpose.
  • Warranty on the custom components, if any, will be passed through from the manufacturer.
  • DiGiCOR shall only perform the installation of such components in a good and workmanlike manner and to standards not less than those generally accepted in the industry. Notwithstanding the above, DiGiCOR shall not be liable for any defects resulting from or relating to the quality, inoperability, functionality, or compatibility issues of custom components.
  • Customer shall be responsible for any and all costs incurred as the result of incompatible or otherwise defective custom components, including but not limited to labour fees, shipping costs, and material costs.
  • Customer agrees to indemnify, defend, and hold DiGiCOR harmless from and against any and all claims, loss or damages, including court costs and legal expenses, arising out of or in connection with this agreement.
  • In the event that additional testing is required due to complications arising from software or any third-party/custom parts installation, the customer shall be responsible for any and all overhead expenses incurred by DiGiCOR.
